State Law vs. Member Requirements
In 2024, after the fallout from the class action lawsuit that was brought on the National Association of REALTORS® a membership mandate was put in place requiring all REALTORS® to obtain a buyer broker agreement (a.k.a. “touring agreement”) in place before showing a property that is listed for sale. This is a member mandate, not a state law requirement.
So let’s take it back of why this only applies to some real estate license holders, not all of them.
In order to be called a “REALTOR” you must be a member of a REALTOR Association.
Just because you hold a real estate license doesn’t mean you are automatically a REALTOR. Remember, REALTOR = Member.
The National Association of REALTORS® might have an influence on real estate license laws and regulations, but they do not make the laws. That’s what your state legislatures and Congress are for.
